Terms of Service
These terms are the agreement between you and Chiviando. By creating an account or using the app, you accept everything described below.

Acceptance of the terms
By downloading, accessing, or using Chiviando, you accept these Terms of Service and the Community Rules, which form part of this agreement. If you do not agree, do not use the app.
These terms apply to all users: customers, chiviadores, and businesses. If you use Chiviando on behalf of a business, you represent that you have authority to bind that business to this agreement.
About the service
Chiviando is a mobile platform for posting chivos, receiving offers, and connecting customers with chiviadores and businesses in Puerto Rico.
Chiviando is only a meeting point. We are not part of any work agreement between users, do not employ chiviadores, do not supervise chivos, and do not guarantee the quality, safety, legality, or outcome of work arranged through the app.
Eligibility
You must be at least 18 years old and have legal capacity to contract to create an account and to post, offer, or accept chivos.
A person or business may operate one primary account. Business accounts require an active subscription to access business features.
Your account
Access is passwordless: you sign in with a link or code we send to your email. You are responsible for keeping your email and device secure and for all activity on your account.
Provide accurate information and keep it up to date. Chiviando may ask you to verify your identity or information before enabling premium features. Notify us immediately if you suspect unauthorized use.
Acceptable use
Use Chiviando only for lawful purposes and in accordance with the Community Rules. There is zero tolerance for objectionable content and abusive users. The content you post is automatically reviewed before publication, and you can report or block any content or user directly in the app.
- Do not post illegal, dangerous, fraudulent work or work that requires evading laws, permits, or taxes.
- Do not offer or request adult services, weapons, drugs, or licensed services presented unsafely.
- Do not share private contact information in posts, comments, or public offers.
- Do not harass, intimidate, discriminate, or distribute hateful content.
- Do not impersonate another person or business, or create false or multiple accounts.
- Do not try to manipulate payments, reviews, moderation, or platform visibility mechanisms.
- Do not use bots or scrapers, or try to access system areas that do not belong to you.
- Do not upload logos, photos, or content you do not own or have permission to use.
Your content
You retain ownership of the content you post (text, photos, offers, messages, and reviews). By posting it, you grant Chiviando a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely to operate and promote the service.
You are solely responsible for your content and represent that you have the necessary rights to post it. We may remove or restrict content that violates these terms, the Community Rules, or the law.
Intellectual property
The Chiviando brand, logo, design, software, and platform content are owned by Chiviando and protected by law. Do not copy, modify, or use them without written permission.
We respect the intellectual property of others. If you believe content on Chiviando infringes your copyright or trademark rights, email support@chiviando.com with the details and we will remove infringing content when appropriate.
Identity verification
A verified badge means only that we reviewed an identity document. It is not a criminal-background check, validation of professional licenses or credentials, or a guarantee that a person or business is safe or competent.
Always use your own judgment when hiring or accepting a chivo. Verification does not replace the diligence you should exercise when dealing with other users.
Payments between users
Chiviando does not process chivo payments, hold funds in escrow, or charge a commission on work. Any economic agreement for a chivo is directly between the customer and chiviador and is their sole responsibility.
We do not mediate payment disputes between users. We recommend agreeing clearly on scope and price before starting.
In-app purchases
Chiviando offers optional purchases: boosts (one-time purchases for visibility) and paid subscriptions. All purchases are processed through Apple’s App Store or Google Play and are subject to those stores’ terms.
Subscriptions automatically renew each period until you cancel. You can manage or cancel them at any time from your store account; cancellation takes effect at the end of the paid period. You can restore previous purchases from the app.
Refunds are handled by the applicable store under its policies; Chiviando does not process refunds directly.
Relationship between the parties
Chiviadores and businesses are independent contractors, not employees, agents, or partners of Chiviando. Nothing in these terms creates an employment, partnership, or agency relationship between you and Chiviando.
Chiviando acts as a neutral intermediary connecting parties. We do not control or take responsibility for user conduct or work they perform outside the platform.
Direct chivo arrangements
An offer, budget, or "open to offers" listing is prepared by a user. It is not a Chiviando quote and does not set or guarantee price, scope, duration, materials, permits, taxes, or availability.
When a customer accepts an offer and the chiviador confirms it, the parties have a direct arrangement. Before work begins, they are responsible for agreeing on scope, price, materials, schedule, changes, cancellations, and payment method.
Marketplace responsibilities
Customers are responsible for evaluating profiles, offers, and whether a chiviador or business is suitable for the work. Chiviadores and businesses are responsible for accurately describing their services and complying with the laws, permits, licenses, insurance, and obligations that apply to their work.
Reviews must reflect real chivo experiences. You may not review yourself or an account you control, or manipulate reviews, moderation, or visibility.
Content, verification, and work disagreements
You are responsible for having the rights needed for the content you post. Verification and badges have the limited meaning described on the Verification page; they do not validate licensing, competence, or results.
Chiviando may review reports of Community Rules violations, but it does not decide who is right in a work disagreement or mediate agreements, payments, refunds, or remedies between users.
Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet particular expectations.
We do not guarantee the identity, background, ability, conduct of any user, or the outcome of any chivo.
Limitation of liability
To the maximum extent permitted by law, Chiviando will not be liable for indirect, incidental, special, or consequential damages, or losses arising from agreements, work, or interactions between users.
Our total liability related to the service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold Chiviando harmless from any claim, damage, or expense (including reasonable legal fees) arising from your use of the service, your content, your chivos, or your breach of these terms or the law.
Suspension and termination
We may suspend or close an account that violates these terms, the Community Rules, or applicable laws.
We act on reports of objectionable content within 24 hours, removing the content and removing the responsible user from the platform.
You can delete your account at any time from Settings. Some data may be retained in de-identified form for trust history, fraud prevention, or legal requirements, as described in the Privacy Policy.
Changes to the terms
We may update these terms when the service or law changes. If we make material changes, we will notify you through reasonable means in the app.
Continued use of Chiviando after a change means you accept the updated terms.
Governing law and dispute resolution
These terms are governed by the laws of the Commonwealth of Puerto Rico, without effect to its conflict-of-law rules.
Before starting any formal action, you agree to try to resolve the dispute in good faith by writing to support@chiviando.com. Any dispute not resolved this way will be submitted to courts with jurisdiction in San Juan, Puerto Rico.
General provisions
If any part of these terms is found invalid, the rest will remain in effect. Our failure to enforce a right at any time does not mean we waive it.
These terms, together with the Community Rules and Privacy Policy, constitute the entire agreement. You may not assign your account or this agreement without our consent; we may assign it in the ordinary course of business.
